RCS Compliance Statement

These terms govern your use of ATAV Telecom's RCS Business Messaging services and comply with Google's RCS Business Messaging Policy, TRAI regulations, and the Telecom Commercial Communications Customer Preference Regulations, 2018.

1. Acceptance of Terms

By accessing or using ATAV Telecom's services, including RCS messaging, GPS tracking, and digital marketing solutions, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

2. RCS Messaging Terms

2.1 Opt-In Consent

You must provide explicit consent to receive RCS business messages from ATAV Telecom. Consent records are maintained for 12 months as per TRAI requirements.

2.2 Opt-Out Mechanism

You may opt-out of RCS messaging at any time by:

  • Replying "STOP" to any RCS message
  • Contacting our support team at +91 7757090344
  • Visiting our Support page

Opt-out requests are processed within 24 hours.

2.3 Message Charges

RCS messages are delivered over data networks. Standard data charges from your telecom provider may apply. ATAV Telecom does not charge for receiving RCS messages.

2.4 Prohibited Content

We strictly prohibit sending via RCS:

  • Illegal products or services
  • Adult or obscene content
  • Misleading or fraudulent offers
  • Phishing or deceptive links
  • Unsolicited promotional messages

3. GPS Tracking Services

3.1 Authorized Use

GPS tracking devices must only be installed on vehicles owned by the customer or with explicit consent of the vehicle owner. Unauthorized tracking is strictly prohibited and may result in immediate service termination.

3.2 Data Accuracy

While we strive for 99.9% accuracy, GPS tracking is subject to satellite availability, network coverage, and environmental factors. We do not guarantee absolute precision.

4. Digital Marketing Services

4.1 Campaign Approval

All marketing campaigns must comply with ASCI (Advertising Standards Council of India) guidelines. We reserve the right to reject campaigns that violate ethical advertising standards.

4.2 Performance Metrics

Reported metrics (impressions, clicks, conversions) are based on standard industry measurement tools. While we ensure accuracy, minor discrepancies may occur due to ad blockers, tracking prevention, or technical limitations.

5. Payment Terms

  • Invoicing: All services are billed in advance or as per the agreed payment schedule
  • GST: 18% GST applicable on all services as per Indian tax laws
  • Late Payment: 2% monthly interest on overdue invoices
  • Refunds: No refunds for services already rendered. Prepaid packages are valid for 12 months

6. Service Level Agreement (SLA)

7. Limitation of Liability

ATAV Telecom's total liability shall not exceed the amount paid by you for services during the 12 months preceding any claim. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions due to telecom network issues
  • Third-party actions or content

8. Termination

We may terminate or suspend services immediately, without prior notice, for:

  • Violation of these Terms
  • Non-payment of fees
  • Illegal or fraudulent activity
  • Spamming or unauthorized messaging

9. Governing Law

These Terms shall be governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.
